Terms of Service

1. Agreement to Terms
By accessing www.hachico.my or engaging Hachico ("Hachico PLT", "we", "us") for services, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and clients.
2. Scope of Services
Hachico provides professional services including Software Development, IT Consultancy, and Copywriting.
3. Intellectual Property (IP) Rights
We distinguish between "Background IP" (Hachico's) and "Deliverables" (Client's owned code/copy).
- Client Deliverables: Upon full payment of fees, the copyright for the specific software code or creative copy created specifically for the Client shall transfer to the Client.
- Hachico Background IP: Hachico retains all rights to its pre-existing tools, frameworks (including the core architecture of The GAJAH Stack), methodologies, and libraries used to create the deliverables. The Client receives a non-exclusive license to use these tools as part of the final product.
4. Client Obligations
To ensure successful project delivery, the Client agrees to provide necessary access to server environments, clear project briefs, and timely feedback. Hachico is not liable for delays caused by the Client's failure to provide required assets.
5. Limitation of Liability
While we strive for perfection ("Precision" being one of our core values), Hachico shall not be liable for any indirect, incidental, or consequential damages, including loss of data or business interruption, arising from the use of our software or services.
6. Third-Party Tools
Our solutions may integrate with third-party technologies (e.g., Open Source libraries, Cloud providers). We act as consultants for these tools but do not own them; their respective terms of service apply.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be resolved exclusively in the courts of Malaysia.
